Prohibited Items Policy

Effective Date: May 5, 2026

Ilovefdl.com is a multi-vendor marketplace operated by I Love Local LLC, based in Fond du Lac, Wisconsin. Vendors are independently responsible for the legality and compliance of every item they list.

1. General Rule

Vendors may not list, sell, or ship any item that violates federal, state, or local law in any jurisdiction relevant to the listing — including the Vendor's location, the buyer's location, and any jurisdiction the item passes through during shipping.

2. Strictly Prohibited Items

The following are not permitted under any circumstances:

Alcohol — Beer, wine, liquor, or any alcoholic beverage. Wisconsin alcohol sales are tightly regulated under Wis. Stat. ch. 125 and require state-issued licenses; the Platform does not facilitate alcohol commerce.

Cannabis & THC — Marijuana, recreational or medical cannabis, hemp-derived intoxicants (Delta-8, Delta-10, THC-O, HHC), and psychoactive products are prohibited on the Platform regardless of jurisdiction. Wisconsin has not legalized recreational or medical cannabis, and the legal status of hemp-derived intoxicants under Wisconsin law remains contested. Topical, non-ingestible CBD products with verifiable THC content below 0.3% may be permitted at the Platform's discretion only if the Vendor provides current Certificates of Analysis for every batch.

Tobacco & Nicotine — Cigarettes, cigars, e-cigarettes, vaping devices, e-liquids, nicotine pouches, or any nicotine-containing product. The federal Tobacco-21 Act and the PACT Act prohibit most online tobacco/nicotine sales without strict age-verification and tax-stamp procedures the Platform does not provide.

Firearms, Ammunition & Components — Firearms of any type, ammunition, primers, gunpowder, magazines, receivers, suppressors, or any regulated firearm component or accessory. Online firearm sales are subject to federal Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) requirements and licensed-dealer transfers that the Platform does not support.

Other Weapons — Brass knuckles, ballistic knives, automatic-opening weapons that violate destination law, stun guns where restricted, and any weapon banned under federal or state law.

Explosives & Hazardous Materials — Fireworks beyond consumer-class limits, flammable or corrosive substances regulated by the Department of Transportation, biological hazards, or radioactive material.

Drugs & Controlled Substances — Prescription medications, controlled substances, drug paraphernalia where restricted, or “research chemicals.”

Stolen, Counterfeit, or Infringing Goods — Items obtained illegally, counterfeit branded merchandise, replica luxury goods, or anything that infringes a third party's intellectual property rights.

Live Animals — Pets, livestock, or wildlife.

Adult Content — Pornographic material, explicit sexual content, or sexually-oriented services.

Anything Otherwise Illegal — If it can't legally be sold or shipped between the Vendor's and Customer's locations, it can't be listed.

3. Knives & Collector Items (Conditional)

Wisconsin specifically. Wisconsin Act 149 of 2015 amended Wis. Stat. § 941.24 to permit the manufacture, sale, transport, purchase, and possession of switchblades and similar knives by adults within the state. Vendors based in Fond du Lac may list collector knives — including switchblades, automatics, and gravity knives — for sale within Wisconsin.

Interstate shipments are different. The federal Switchblade Knife Act (15 U.S.C. §§ 1241–1245) still prohibits the introduction of switchblades into interstate commerce, with limited exceptions (military, common carrier shipment between dealers, etc.). Many other states (e.g., New York's gravity-knife rules, Illinois, Hawaii, parts of California) restrict or ban specific blade mechanisms regardless of Wisconsin's permissive stance.

Vendors selling knives must:

  • Verify legality in both their own and the buyer's jurisdiction before shipping
  • Refuse and refund orders to states where the specific knife is prohibited — the Platform does not pre-screen
  • Comply with the federal Switchblade Knife Act for any out-of-state shipment of an automatic or switchblade knife
  • Accurately describe blade type, length, and locking/opening mechanism
  • Apply age-verified or signature-required carriers when destination law requires it
  • Be aware that some carriers (USPS, FedEx, UPS) have their own switchblade and ballistic-knife restrictions that may apply even where state law allows the sale

The Platform provides no legal advice on knife law. Compliance is entirely the Vendor's responsibility.

4. Vendor Responsibility

Vendors are 100% responsible for:

  • Confirming each item is legal to sell in every jurisdiction the item will travel to
  • Holding all required licenses, permits, age-verification systems, and tax registrations
  • Bearing all civil, criminal, regulatory, and financial consequences of any prohibited listing or sale

5. Platform Rights

I Love Local LLC reserves the right, at our sole discretion and without notice, to:

  • Remove any listing
  • Suspend or terminate any Vendor account
  • Withhold payouts pending investigation of suspected violations
  • Cooperate fully with law enforcement, including disclosing Vendor and order information when legally compelled
  • Take any other action we determine necessary to protect the Platform, Customers, or third parties

6. No Monitoring or Verification

We do not pre-screen listings, verify Vendor licenses or permits, or audit compliance. The absence of enforcement against any specific listing does not constitute approval. Vendors cannot rely on the Platform's review of any listing as evidence of legality.

7. Liability Disclaimer

I Love Local LLC is a platform provider only. We are not a seller, importer, or distributor of any product listed by a Vendor.

I Love Local LLC bears no liability — civil, criminal, regulatory, or otherwise — for any prohibited item listed, sold, or shipped by a Vendor. All such liability rests solely and entirely with the Vendor.

8. Reporting Violations

If you believe a listing violates this Policy, email info@ilovefdl.com with the listing URL and a brief description of the issue. We review all reports promptly but are not obligated to take any specific action.

9. Changes to This Policy

We may update this Policy at any time. Continued use of the Platform after changes take effect constitutes acceptance.
